ORDINANCE NO. 478
AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF LA PORTE CITY, IOWA,
OF SUBSECTION 2, SECTION 2, CHAPTER 45,
ALCOHOL CONSUMPTION AND INTOXICATION
BE IT ENACTED by the City Council of the City of La Porte City, Iowa:
SECTION 1. SECTION REPEALED AND REPLACED. The Code of Ordinances of the City of La Porte City, Iowa, is hereby amended by deleting the existing Subsection 2, Section 2, Chapter 45 and adopting the following new Subsection 2, Section 2, Chapter 45 in lieu thereof:
2. A person shall not use or consume alcoholic liquor, wine or beer upon the public streets or highways. A person shall not use or consume alcoholic beverages in any public place, except premises covered by a license issued by the State of Iowa Alcoholic Beverages Division or by Council resolution for a City Festival. A person shall not possess or consume alcoholic liquors, wine or beer on public school property or while attending any public or private school-related function. A person shall not be intoxicated or simulate intoxication in a public place.
SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole, or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
