COUNCIL PROCEEDINGS May 12, 2014
The City Council of La Porte City, Iowa met in regular session on May 12, 2014. Mayor David Neil called the meeting to order at 7:00 PM with Council Members Eric Allsup, Sarah Craft and Brent Sadler present. Absent were Council Members Todd Butler and Mike Johnson. Also present were Jen Sparks, Gerald Rife, Heather Weideman, Madison Dierks and Mark Bergmeier.
Unless otherwise noted, all actions were passed by affirmative and unanimous vote of the council members present.
Moved by Allsup, seconded by Craft to approve the AGENDA.
Moved by Craft, seconded by Sadler to approve the CONSENT AGENDA including the following: Minutes of April 28, 2014, Disbursements totaling $81,593.89, Police Report for April, 2014 and Parks & Rec Commission meeting minutes from March and April, 2014.
Moved by Craft, seconded by Allsup to approve the BUILDING & ZONING REPORT FOR APRIL, 2014.
Moved by Craft, seconded by Sadler to approve the PRESEASON POOL REPORT.
Moved by Craft, seconded by Sadler to WAIVE PARK SHELTER RENTAL FEE FOR DON’T PROGRAM. The DON’T program (Drugs Offer No Tomorrow), is a alcohol/drug abuse prevention program for 6th grade students and Union Middle School. The program will hold its annual fun run and picnic on May 15, 2014 at the City Park.
Moved by Craft, seconded by Sadler to amend section 76.06 of the proposed ORDINANCE ADDING CHAPTER 76 TO THE LA PORTE CITY CODE OF ORDINANCES – PERTAINING TO GOLF CARTS to include the following: Golf carts are prohibited from operating on sidewalks and designated recreation trails in the City including the Cedar Valley Nature Trail and Wolf Creek Trail from Main Street (near Fire Station) to 8th Street (near the gazebo). Carts are allowed on the recreational trail from Anton Drive to Bluff Street.
Moved by Sadler, seconded by Allsup to approve the first reading on “AN ORDINANCE ADDING CHAPTER 76 TO THE LA PORTE CITY CODE OF ORDINANCES – PERTAINING TO GOLF CARTS.” The ordinance would allow operation of golf carts on certain streets in the City as authorized by Section 321.247 of the Code of Iowa. The second reading will take place at the May 27th City Council meeting.
Moved by Craft, seconded by Allsup to approve a “RESOLUTION SETTING SALARIES FOR SEASONAL PUBLIC WORKS AND PARKS EMPLOYEES” The resolution sets the salary for seasonal public works employee Gerry Jacobsen at $12.00/hr. and seasonal parks employee Al Blocker at $9.00/hr.
Moved by Craft, seconded by Allsup to approve a “RESOLUTION SETTING SALARY FOR MUSEUM CUSTODIAN” The resolution sets the salary for Museum custodian Jenny Curtis at $150.00 per cleaning.
Moved by Allsup, seconded by Craft to approve a “RESOLUTION APPROVING UPDATE TO EMPLOYEE MANUAL”. The resolution defines a casual or temporary employee as someone who works less than 120 days in a calendar year.
Moved by Allsup, seconded by Craft to approve a “RESOLUTION SETTING TIME AND DATE FOR PUBLIC HEARING ON SALE OF PUBLIC PROPERTY” The resolution sets the public hearing date for the Council to consider an offer to purchase Lot 29 at Sweet First Addition. The public hearing will take place at the May 27th, 2014 City Council meeting.
Moved by Allsup, seconded by Sadler to approve the BID TO REPLACE FURNACE IN POLICE DEPARTMENT from Craft Plumbing & Heating, Inc. for a 2 ton, 16 SEER unit at a cost of $5,363.69. The bid also includes interior work to improve air flow. The City will also be eligible for a $400 rebate from Black Hills Energy.
Moved by Sadler, seconded by Craft to approve the BID FOR APPRAISAL SERVICE. The bid, from Iowa Appraisal and Research is for $2,000.00. The City is considering the purchase of property in conjunction with a REAP grant application.
Moved by Craft, seconded by Allsup to approve the NUISANCE ABATEMENT PROCEDURE. City staff will develop recommendations for a fee schedule for civil citations for nuisance abatement.
