COUNCIL PROCEEDINGS                                                                                                                               July 23, 2013

The City Council of La Porte City, Iowa met in regular session on July 23, 2013.  Mayor Pro-tem Kathy Norris called the meeting to order at 7:00 PM with Council Members Sarah Craft, Mike Johnson and Kim Ortiz present. Absent were Mayor Rick Lubben and Council Member Todd Butler. Also present were Public Works Director Sam Weich, Mat Saur, David Butler and Raquel Smith.

Moved by Craft, seconded by Otiz to approve the AGENDA. Motion carried 4-0.

Moved by Ortiz, seconded by Craft to approve the CONSENT AGENDA including the July 8th, 2013 Minutes, Disbursements totaling $132,485.59, Public Works Report for June, 2013 and Hawkins Memorial Library Board Minutes from July 15, 2013. Motion carried 4-0 with Craft abstaining from payments to Dutton, Braun, Staack & Hellman due to a conflict of interest.

Council Member Todd Butler arrived at 7:02PM.

Moved by Craft, seconded by Butler to approve the second reading of “AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE CITY, IOWA, CHAPTER 69.09, ALL NIGHT PARKING ON MAIN STREET.”  The ordinance amends Chapter 60.09 of the City Code to allow overnight parking on Main Street between Locust and Walnut on Fridays and Saturdays.  Roll call vote passed 5-0.  Moved by Johnson, seconded by Craft to suspend the rules requiring three readings and move to the third and final reading. Roll call vote passed 5-0 and Mayor Pro Tem Norris declared Ordinance 475 adopted and effective upon publication.

Moved by Craft, seconded by Ortiz to approve the second reading of “AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE CITY, IOWA, CHAPTER 50.11, NUISANCE ABATEMENT – COLLECTION OF COSTS.”  The ordinance amends Chapter 50.11 of the City Code to increase the minimum amount that can be paid back in installments through property taxes from $100.00 to $500.00 in accordance with the Code of Iowa.  Roll call vote passed 5-0. Moved by Butler, seconded by Johnson to suspend the rules requiring three readings and move to the third reading. Roll call vote passed 5-0 and Mayor Pro Tem Norris declared Ordinance 476 adopted and effective upon publication.

Mat Saur with MSA Professional Services reviewed the BIDS FOR 2013 STREET REHABILITATION PROJECT (PHASE I) REBID:

Pirc-Tobin Construction     $422,031.82

Tschiggfrie Construction    $422,910.28

 

Phase I includes the resurfacing of portions of Bishop Avenue, Maple, First and Adams Street.

Moved by Johnson, seconded by Ortiz to approve a “RESOLUTION AWARDING BID FOR 2013 STREET REHABILITATION (PHASE I) REBID”. The resolution awards the bid in the amount of $422,031.82 for the resurfacing of portions of Bishop Avenue, Maple, First and Adams Street to Pirc-Tobin Construction. Roll call vote passed 5-0 and Mayor Pro Tem Norris declared Resolution 13-68 adopted.

Moved by Craft, seconded by Butler to approve a “RESOLUTION TO TRANSFER FUNDS FROM EQUIPMENT REPLACEMENT TO GENERAL FUND”.  The resolution approves the transfer of $27,900.00 for the purchase of a mower for the parks department.  Roll call vote passed 5-0 and Mayor Pro Tem Norris declared Resolution 13-69 adopted.

Moved by Craft, seconded by Butler to approve a “RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO A 28E AGREEMENT WITH UNION COMMUNITY SCHOOL DISTRICT FOR PURPOSE OF ESTABLISHING OF A COMMUNITY ORCHARD”. The agreements provides for the establishment of community orchards on properties located at the corner of Main and Oak Streets. Roll call vote passed 5-0 and Mayor Pro Tem Norris declared Resolution 13-70 adopted.

Moved by Johnson, seconded by Ortiz to approve a “RESOLUTION AMENDING THE CITY OF LA PORTE CITY EMPLOYEE HANDBOOK REGARDING VACATION DAYS”. The amendment updates the way in which vacation days are awarded to new employees by pro-rating vacation days awarded on the first anniversary. Roll call vote passed 5-0 and Mayor Pro Tem Norris declared Resolution 13-71 adopted.

Moved by Craft, seconded by Butler to approve the first reading of “AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LA PORTE CITY, IOWA, CHAPTER 50.13, NUISANCE ABATEMENT – REQUEST FOR HEARING.”  The ordinance adds Chapter 50.13 of the City Code which details the procedure for requesting a hearing in a nuisance abatement matter.  Roll call vote passed 5-0. The second reading will take place at the August 12th Council meeting.

The Council reviewed a REQUEST FOR REIMBURSEMENT OF CLEAN UP COSTS from Raquel Smith.  The basement of a property owned by Smith was flooded due to sewer backup on July 4, 2013.  Smith requested that the City pay for the cleanup costs after it was determined that the issue was in the City’s main, not the property owner’s service line.  The requested reimbursement amount was $421.31. Moved by Butler, seconded by Ortiz to approve the reimbursement for clean-up costs. Motion carried 5-0.

Public Works Director Sam Weich presented a proposal for eliminating trip hazards on City sidewalks by Precision Concrete Cutting. Weich would like to have the company present an estimate on the cost to repair sidewalks with trip hazards.

The Council discussed hiring PART-TIME SEASONAL help for smaller street repairs.  Moved by Ortiz, seconded by Craft to authorize the Clerk to advertise for seasonal help positions. Motion carried 5-0.

Nile Johnson informed the Council that there are no yield or stop signs on 5th Street and only one on 6th Street. Johnson asked the Council to consider installing speed limit signs, children playing signs on Spruce Street. Weich indicated that Children Playing signs can be installed without the need for Council action.  Stop signs will require a change in ordinance.

Moved by Craft, seconded by Ortiz to adjourn at 7:43PM. Motion carried 5-0.
