Council Meeting 1/28/2013

COUNCIL PROCEEDINGS                                                                                                              January 28, 2013

The City Council of La Porte City, Iowa met in regular session on January 28, 2013.  Mayor Rick Lubben called the meeting to order at 7:00 PM with Council Members Todd Butler, Sarah Craft, Mike Johnson, Kathy Norris and Kim Ortiz present. Also present were Larry Feaker and Corey Lorenzen.

Moved by Ortiz, seconded by Craft to approve the AGENDA. Motion carried 5-0.

Moved by Norris, seconded by Craft to approve the CONSENT AGENDA including the January 14th Minutes, December 2012 Receipts, Assessment Report and Disbursements totaling $75,652.74. Motion carried 5-0 with Craft abstaining from payments to Dutton, Braun, Staack & Hellman.

City Attorney Lorenzen updated the Council on the latest developments in the City’s proceedings against Koopman.  The meeting of creditors took place and there are some questions left to be answered by Koopman. Lorenzen has filed a non-dischargability complaint in the case. The complaint requests that the court not discharge the City’s claim against Mr. Koopman.  Lorenzen will also be requesting additional financial documents from Koopman in the case.

Moved by Norris, seconded Craft to approve the PUBLIC WORKS REPORT. Motion carried 5-0.

Moved by Norris, seconded by Craft to approve the POLICE REPORT. Motion carried 5-0.

Moved by Craft, seconded by Ortiz to approve the CLERK’S REPORT. Motion carried 5-0.

Moved by Butler, seconded by Craft to SET TIME AND DATE FOR PUBLIC HEARING FOR FISCAL 2014 BUDGET. Motion carried 5-0.  The public hearing will take place on February 25, 2013 at 7:00pm at City Hall.

Moved by Craft, seconded by Ortiz to approve a “RESOLUTION TO TRANSFER FUNDS FROM MUSEUM TRUST TO GENERAL FUND”. The resolution approves the transfer of $62,248.52 to cover costs related to the renovation of the City’s Historic Jail. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-03 adopted.

Moved by Norris, seconded by Ortiz to approve a “RESOLUTION TO TRANSFER FUNDS FROM MUSEUM TRUST TO GENERAL FUND”. The resolution approves the transfer of $2,673.52 to cover costs related to Museum fundraising activities for FY2012. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-04 adopted.

Moved by Craft, seconded by Norris to approve a “RESOLUTION TO TRANSFER FUNDS FROM MUSEUM TRUST TO GENERAL FUND”. The resolution approves the transfer of $7,608.75 to cover one half of the Museum Director’s salary for FY 2012. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-05 adopted.

Moved by Norris, seconded by Ortiz to approve changes to the CITY CREDIT CARD POLICY.  The changes include authorizing a VISA credit card for Fire Chief Shane Clark and Ambulance Captain Borge Johnson. Both cards will have a $2,000 credit limit. Motion carried 5-0.

Moved by Norris, seconded by Ortiz to approve the request by Dave Hopkins to PLACE A DUMPSTER ON CITY PROPERTY.  Hopkins would like to place a dumpster next to his building located at 408 Commercial and directly behind the La Porte City Community Center. The dumpster would not block the sidewalk and would be in place for no more than seven (7) days. Motion carried 5-0.

The Council reviewed a tentative schedule and maps for the FESTIVAL OF TRAILS CELEBRATION.  The site plan for the celebration shows some major changes from past years.  Concerns about the placement of the stage and available electricity were voiced.  The City Clerk will contact the Lions Club to discuss.  Once plans are finalized, the La Porte City Lions Club will submit a formal request for street closings in the affected areas.

Moved by Butler, seconded Craft to adjourn at 7:36PM. Motion carried 5-0.
