COUNCIL PROCEEDINGS March 25, 2013
The City Council of La Porte City, Iowa met in regular session on March 25, 2013. Mayor Rick Lubben called the meeting to order at 7:00 PM with Council Members Todd Butler, Sarah Craft, Mike Johnson, Kathy Norris and Kim Ortiz present. Also present were City Attorney Corey Lorenzen, Assistant Public Works Director Rob Williams, Library Director Jolene Kronschnabel, Mary Bader, Shawn Sheffler, Mike Strubel and Chad VanDyke.

Moved by Norris, seconded by Craft to approve the AGENDA, striking item 7c “RESOLUTION ALLOCATING MUSEUM BEQUEST OF ALICE JANSS.” Motion carried 5-0.

Moved by Butler, seconded by Craft to approve the CONSENT AGENDA including the March 11th Minutes, February 2013 Receipts, Disbursements totaling $72,007.17 and Museum Board minutes for February 19, 2013. Motion carried 5-0.

City Attorney Corey Lorenzen reported scheduling conference is for Friday to set a trial date for the Koopman bankruptcy case. The date could be as much as nine months from now. Koopman has been granted a discharge of his general debts, the trial is to determine whether the City’s claim against Koopman should be set aside.

Moved by Craft, seconded by Butler to approve the PUBLIC WORKS REPORT. Motion carried 5-0.

Moved by Butler, seconded by Craft to approve the CLERK’S REPORT. Motion carried 5-0.

Moved by Norris, seconded by Butler to approve a “RESOLUTION SETTING HOURS FOR FAMILY AQUATIC CENTER”. The resolution sets hours of 1PM – 4PM and 6:30PM – 8:30PM Monday through Saturday and 1PM – 6PM on Sundays for the La Porte City Family Aquatic. Council member Craft indicated that she preferred that the resolution be changed to 1PM – 4:30PM and 6:30PM – 8:30PM on Sundays. Mayor Lubben asked if either Norris or Butler would like to withdraw their motion or second. Butler withdrew his second and Norris withdrew her motion. Moved by Norris, seconded by Ortiz to approve a “RESOLUTION SETTING HOURS FOR FAMILY AQUATIC CENTER”. The resolution sets hours of 1PM – 4:30PM and 6:30PM – 8:30PM Monday through Saturday and 1PM – 6PM on Sundays for the La Porte City Family Aquatic Center. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-16 adopted.

Moved by Butler, seconded by Johnson to approve POLICY ON LARGE DONATIONS. The policy requires Council approval for the allocation of donations in excess of $25,000 made to City departments. Motion carried 5-0.

The Council reviewed BIDS FOR NEW GARBAGE TRUCK. The new truck will have a cart tipper to reduce lifting by City employees. The City will also purchase containers that must be used for garbage and recycling pickup. Bids were received from two sources:

Moved by Butler, seconded by Johnson to approve the purchase of garbage truck and containers from Mid-Iowa for a total cost of $209,783.36. Motion carried 5-0.

Moved by Norris, seconded by Craft to approve a “RESOLUTION TO SET DATES OF CONSULTATION AND A PUBLIC HEARING ON URBAN RENEWAL PLAN AMENDMENT #4.” An amendment to the City’s Urban Renewal Plan is a requirement before the City can offer new tax increment financing incentives. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-17 adopted.

Moved by Norris, seconded by Ortiz to table a Item 8b, a “RESOLUTION APPROVING STREET CLOSURES FOR THE FESTIVAL OF TRAILS CELEBRATION.” The Council tabled the Resolution until the April 9th meeting, after affected businesses have been notified. Motion carried 5-0.

After extensive discussion, the Council tabled action on the “RESOLUTION APPROVING THE PURCHASE OF REAL ESTATE” while the property owner was contacted to clarify some details of the offer. The property in question is located at 208 Main Street.

Moved by Norris, seconded by Ortiz to approve a “RESOLUTION SETTING SALARY FOR POLICE OFFICER.” The resolution sets the wage for police officer Joy Vandervolk at $15.78/hr in accordance with the terms the Teamsters Local 238 contract. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-18 adopted.

Moved by to Norris seconded by Craft approve a “RESOLUTION UPDATING THE LA PORTE CITY EMPLOYEE HANDBOOK.” The resolution amends language regarding employee health insurance contribution to allow non-bargaining unit employees to contribute up to 15% of the cost of their health insurance policy. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-19 adopted.

Moved by Johnson seconded by Butler to approve a “RESOLUTION UPDATING THE LA PORTE CITY EMPLOYEE HANDBOOK.” The resolution amends language regarding employee holidays to exclude the Library Director from holiday pay for President’s Day at the direction of the Hawkins Memorial Library Board of Trustees. Roll call vote passed 5-0 and Mayor Lubben declared Resolution 13-20 adopted.

Moved by Craft, seconded by Ortiz to approve a “RESOLUTION RESCHEDULING THE REGULAR DATE OF THE SECOND COUNCIL MEETING FOR THE MONTH OF MAY, 2013”. The resolution changes the date for the second regular meeting in May of the City Council from Monday, May 27th to Tuesday, May 28th because of the Memorial Day Holiday. Roll call vote passed 3-0 and Mayor Lubben declared Resolution 13-21 adopted.

Moved by Norris, seconded by Otiz to set time and date for PUBLIC HEARING ON FY 2013 BUDGET AMENDMENT. Motion carried 5-0. The public hearing will take place on May 28th, 2013.

Moved by Johnson, seconded by Norris to approve the IOWA DEPARTMENT OF TRANSPORTATION CONTRACT FOR HWY 218 BRIDGE PROJECT. The agreement between the City and the Iowa Department of Transportation provides for improvements to the Highway 218 bridge. Motion carried 5-0. Construction is expected to begin in Spring, 2014.

Moved by to Johnson, seconded by Craft to reject the offer for PURCHASE OF PROPERTY LOCATED AT 208 MAIN STREET as presented. Motion failed 2-3 with Butler, Norris and Ortiz opposed.

Moved by Norris, seconded by Ortiz to request an extension of 30 days of the offer for PURCHASE OF PROPERTY LOCATED AT 208 MAIN STREET and request to solicit bids on roof replacement, and to conduct lead and asbestos testing without causing major damage to the structure. Motion carried 3-2 with Craft and Johnson opposed.

Moved by Butler seconded by Craft to adjourn at 8:39PM. Motion carried 5-0.

    Thank you for changing the swimming pool hours. While my own family woud have peferred the old schedule of 7-9 PM for the evening hours to allow us to go swimming after the adults get home, get supper, etc, the extra half hour later than t he 8 pm close time last year, will make a nice difference. Thanks again.
